Lindsay Lohan’s lawsuit against GTA V has been thrown out of court

Lindsay Lohan’s long running lawsuit with Rockstar Games has been dismissed by a court judge this weekend.

In 2014, Lohan claimed that an illustration that featured in Grand Theft Auto V was based on a photograph of her.

The illustration, which featured a blonde woman in a red bikini taking a selfie, which featured prominently in GTA V’s promotional art, even featuring as a cover in some versions of the game. Lohan claimed the art co-opted her “signature peace sign”.

Lindsay Lohan also claimed that the in-game character of Lacey Jonas was based on her.

In the game, Jonas is a former child actor, turned tearaway, who Franklin can rescue from swarms of paparazzi.

Lohan’s lawsuit, said that the places and events in both characters’ storylines were “substantially similar” to her own life and there could be no doubt about who the game was sending up.

“It is unequivocal that the Plaintiff was the intended referent in the GTA V game by using her likenesses, portraits, and voice solely to advertise the game for trade purposes and by specifically announcing the Plaintiff’s name in the media as a ‘Lindsay Lohan look-alike side mission’ at least two months before the release of the game purely to promote, hype the game to attract sales of the defendants video game,” read the complaint.

However, this week a judge ruled that Lohan’s case had no grounds.

“This video game’s unique story, characters, dialogue, and environment, combined with the player’s ability to choose how to proceed in the game, render it a work of fiction and satire,” reads the ruling, issued from a five-judge panel in Manhattan appeals court on Tuesday.

Lohan’s lawyer Robert Pritchard told US media the actress would appeal the ruling.
