He could earn millions in compensation.

Lawyers for David Dao, the passenger that was forcibly removed from a United Airlines flight, have filed an emergency court request for the airline to preserve evidence.

A lawyer for Dao filed a petition with the Cook County Circuit Court which demands that United Airlines and the City of Chicago preserve all surveillance videos, cockpit voice recordings, passenger and crew lists related to the flight, a first step in potential litigation.

The filing said “after being duly processed by the ticket agent, checked in by the attendant and seated in his assigned passenger seat, Petitioner was forcibly dragged and removed from the said aircraft by City employees, sustaining personal injury.”

David Dao was filmed being dragged off the overbooked flight at Chicago O’Hare airport, bloodied and screaming, in a video that was watched millions of times online.

Since the incident occurred, United Airlines said they would refund the ticket costs of all passengers on Sunday’s flight, however, the airline’s chief executive, Oscar Munoz, has reiterated that he will not resign while expressing his “shame and embarrassment” over an incident that he regarded as “truly horrific.”

Shares in United fell 1.1% to end the trading day at $69.93.

As of Tuesday, Mr Dao was still recovering in hospital.
