Lindsay Lohan gets the greenlight to sue Rockstar Games

Jordan Gold

Was Lindsay Lohan the inspiration for drugged-up Los Santos starlet Lacey Jones in the latest GTA game?
Lindsay thinks she was. And the courts seem to agree.
The New York Supreme Court has ruled that Lohan can proceed in her suit against Rockstar Games for “misuse of her image”, claiming that the character’s traits were based on the actress’s appearance and personality.

Take-Two, the company that owns Rockstar, continues to claim the character is not based on Lohan. And even if it is, a parody may not be enough grounds for legal action. But the case sets an interesting precedent for the future of copyright.
Lohan’s legal team responded to Take-Two’s argument back in October of 2014, adding dozens of images to its complaint:
“The Defendants were in the business of selling games as opposed to artists displaying artwork in galleries for profit where unauthorized images or portraits of individuals were reproduced in limited editions as opposed to the mass production for commercial promotion and financial gain.”
Is it definitively a Lindsay rip-off, or is it a homage? GTA V made $88million in a single day, so the company wouldn’t be left too strapped if it had to pay Lindsay a few quid.
