The Supreme Court has ruled against Theresa May’s plans for Brexit and ruled that MPs are entitled to vote on whether or not to trigger Article 50.
The ruling is one of the most important in UK constitutional law history.
The Supreme Court was ruling on whether Theresa May has the right to trigger Article 50 of the Lisbon Treaty or whether she must seek approval from the British parliament.
The Prime Minister will now have to give the British Parliament a chance to vote on triggering Article 50, which is the mechanism on which the EU withdrawal can formally begin for the UK.
The ruling on the requirement for parliamentary approval was initially made in November by the British High Court but was appealed to the Supreme Court by the UK government.
It remains unclear what the legal recourse will be if the option to trigger Article 50 is rejected by the MPs but it would be unlikely to fail given that Jeremy Corbyn has instructed his Labour Party to vote not to obstruct it.
